Experts
report that 70% of all Americans have no written estate plan. And,
of those who have planned, most have created a simple will or rely
on joint tenancy ownership of their assets to distribute their
estate. Unfortunately, for the majority who have no plan in place,
state law will dictate how their estate is to be distributed at
death.
Durable Power of Attorney (Asset mgmt)
A document granting one person (the
attorney-in-fact) the authority to act on behalf of the principal,
which remains valid even in the event of disability. A plain (not
durable) power of attorney is not valid in the event of disability.
A general power of attorney authorizes the attorney-in-fact to act
for the principal in all matters, while a special power of attorney
is limited to certain specified matters

Through this type of advance directive, an
individual executes legal documents which provide the power of
attorney to others in the case of an incapacitating medical
condition. The durable power of attorney allows an individual to
make bank transactions, sign Social Security checks, apply for
disability, or simply write checks to pay the utility bill while an
individual is medically incapacitated.
